filing of MTR does not give you status, once they accept it, yes you are in status again.

I don't think 90k for someone with 7-8 years of experience is high in most parts of US. Market rate for IT professionals might have increased in people working with niche technologies. But in general, I see a down trend. And with more people in the job market in Jan 08 (with AC21), I can predict the rates heading south.
Everyone of those people using AC21 will come from an existing job. They will typically go to a higher paying job. Every one of those jobs vacated will have to be sought on the open market, where they'll have market rates of today vs three years ago.
So my glass is half full. :D

Wow, these have to be the best pixel art designs I have seen created. I voted for soul's because it just simple, angled. I also really liked all the things going on in eilsoe's graphic. If it wasn't for the wall eilsoe (I like cool slanted, twisted things) I would have def voted for your cool graphic. It was more of a tie between both of you guys really =)

My take on it is that more jobs will be outsourced and only few core people important for a business will retain the jobs and also the salary hikes. This is assuming that offshoring companies mature over the period of time and move up in the service chain in terms of value of services they provide. The current trend is towards translating business requirements here and getting the programming done through some offshoring entity. The preferred vendors are benefiting enormously and so are the companies outsourcing. From a business point of view, technology is an enabler for competitve advantage. So critical and complex projects will still be done here through few core people.
I believe we can survive quite well in the global economy. I am more worried about future of American kids and the education system here. Unless they prepare well for the global economy, America will be in rude shock. Bush is not helping either, dumping the money on wars and creating boats load of debt burden for future generations.

well this is your time. with eb3 row 2009, you probably are in wait for at least 5 years. Anyway the point is, no country would be stupid enough to stop great talent from coming through to satisfy it's diversity policy. When you are talking about 0.14 million immigrants for a nation of 300 million, that's less than 0.05%. So please take your diversity argument with you and don't let the door hit you on your way out. For this miniscule percentage, the US will lose out on thousands of the best Indian and Chinese engineering/science talent. US's loss, India/China's gain. If this is not an example of an extremely stupid strategic policy then I'm not sure what is.
Oh and by the way, may not be me or you waiting for Indian/Chinese GC's but could be your kid and mine. Let's have this talk again in a decade or two given GDP growth,debt and deficits of US and GDP growths/deficits/market size of India/China.

Your case is a bit different, I am not sure if you could avoid paying back as GC process is for your benefit so a company could request a pay-back, even though amount is a bit high and you did not get anything in return. I would compare it to a situation where company gives an employee a laptop and expect person to return it when s/he leaves a company.
helloh1's clause is different - company receives benefits by training its employees so it's just plain wrong to request a pay back in that case.
So just forget about it and move on, we all make mistakes and here in the US those mistakes usually cost money.

I have beein the US for over 6 years yet I still don't have my GC. I applied for it in 2001, got laid off, switched companies and finally I'm with a company I joined 3 years go and my PD is Oct2004 w/140 approved on 04/2005 EB-3 waiting to file my 485.
I used to worry about this GC a lot and then said to myself a lot of +ve things and today I have really moved on and I worry less abt the GC today. I am doing great & more or less like what you are into : got 2 houses, one in India and the other in US, kid, wonderful Wife on H4, a great family and floated my own start-up in India. I have a great job here in the US too, working on my PMP cert and am also looking for a part-time gig here.
So, really, life is good. Here is a thing though, as some of our other friends had mentioned :the GC is all about Security, Free mobility(my client wants me to go to France, but I have been putting off b/c of Visa re-val and stuff) and Growth". Today, my client also wants to hire me and offer me a PM postion , but unfortuantely they don't want to sponsor Visas, not that they don't sponsor Visas at all. Although, I got pissed off after the Oct bulletin but I'm keeping my chin-up and hoping that I'll see the light at the end of the tunnel some day.
So, cheer up have fun, live life to the fullest and enjoy!!!!
OK, now can someone start a thread for Nov bulletin predictions :)

I have several friends who were waiting for GC desparately and they thought it was the final destination. They had many reasons why to get GC and once they get, they will be free and can do / will do everything possible. But, once they got it, they settled in a permanent job. Without GC, they were working for the same client with even more pay and life was good if not better.
I was thinking the same way; because I am no different.
Oflate, I realised, I am un-necessarily worried about something which is not in my control. I realised that I am well paid, with this pay even the benefits I am not getting are compensated. Why am I worried? Should I be after GC in order to get peace of mind? I started looking it little differently. I am in this country to earn more money and live comfortably. I am already enjoying what I wanted. Then, why am I worried still? May be it is in human nature to always look for something which is not in the hands.
I still need GC for other things like Children education and get some other benefits (our education / starting business etc). I agree, but there is lot of time for that in my case. There are several people who are in the same state as me if not all. Everyone's needs are different.
I thought I will just share my ideas so that atleast some of the people will be happier.

Try getting info from any other consulate...you will feel the same.... I used to feel the same until I dealt with UK / French /Italian consulates for tourist visa....it was as horrible...
I dealt with the UK consulate and the CGI India at Chicago. Now, agreed this was many years ago, when I used to have a desi passport.
There was an awesome Asst. Consular Officer (i forget the exact designation), but her name was Deepa Jain. I submitted my desi passpost for renewal at CGI Chicago, using the procedure described on their then brand new website. Waited 4 weeks, nothing. This was in 1999, so I decided to call the conculate, totally expecting nobody to pickup the phone, but to my surprise, somebody picked up!!. I gave them the details of my application and old passport and the lady who answered the phone said "we will call you back".
Now, knowing what that means, I began to prepare myslef for weeks and possibly months of frustration..BUT...lo and behold, two days after my call to them, Ms. Deepa Jain called back ON MY cellphone to tell me "your passport was renewed and I wil lmake sure it gets sent out today itself!!". To tel you the truth, I was totally blown away, and if Ms Jain is still around in any of the consulates, hats off to you...but I digress..
Now comes the part with the UK consulate, again, in Chicago.
I wanted to visit UK and applied for a visitors visa providing them will all the things that they need. Their requirements are very stringent and they want a ton of information too.
The delightful englishwoman at the counter in UK consulate started to ask me all sorts of questions while leafing thru my documents. When she saw a copyof my Canadian PR card in there, she stopped and asked me to show her the original card, which I did. Once she saw it, that was it. Her next statement was "You may pick up your passport in the afternoon".
So, two things, it is the desi sarkari babus who mess it up for us, in the consulates and it is the poor image "enjoyed" by our desi passports (which used to be hand written" up until a few years ago) that create problems for us in the non-Indian consulates (European ones to be precise)J.apanese, Korean and othe Asian consulates tend to be much better in this regard.

Hello BharatPremi,
I was in the Interfiling situation for the last four months but EB2 India was Retrogressed and then Unavailable as you know. But, I got the advice from my Lawyer that I should Interfile and not wait for the EB2 India dates to get current. So, at the end of Feb '08 I decided to Interfile with my lawyer's help.
With the cover letter as suggested in various earlier posts he made sure he sent the Original Approval Notice of the I140 and not a copy.
The main text of the letter was:
In accordance with 8 C.F.R. �204.5(e) , the applicant hereby request your office to amend the priority date to that of <new I140 Priority Date> as indicated on the enclosed original approved I-140 petition on behalf of the applicant.
In the footnotes, this was included:
1. A petition approved on behalf of an alien under sections 203(b) (1), (2), or (3) of the Act accords the alien the priority date of the approved petition for any subsequently filed petition for any classification under sections 203(b) (1), (2), or (3) of the Act for which the alien may qualify. In the event that the alien is the beneficiary of multiple petitions under sections 203(b) (1), (2), or (3) of the Act, the alien shall be entitled to the earliest priority date.
It was beginning of March when this was done. Then in mid-March, I got the great news that EB2 India is current for my PD. We will see what happens in April '08 !!!
No news from USCIS yet on the Interfiling app. My lawyer suggested to call after a month of the application's RD.
Waiting on GC for more than 6 years. I hope this is the last thing to do before AOS is approved for us and we receive the PR Card.

I don't think PMP is useful in promotions......it may be helpful in getting a new job though.....but then you are limited in your career..........PMP doesn't help you moving upwards.....!

For all Eb3s along with EB2s with PD after April 2005, the movement in the coming visa bulletins wont be much encoraging unless the new Obama government does something significant about employent based category or immigrationvoice does a fruitful lobbying. The doings of something by obama government to employment based category is not in our hands. The only thing we could do is to help IV and help ourrselves by contributing to it to reach its financial target for better lobbying. Or else wait for the Visa Bulletin every month with great hopes, sorry dreams, for your PD to become current, and satisfy with your EADs for years ahead
