Hey hey, I don't have to apply with my current legal name do I? ;)
You know what RFES for Z1 visa would be easy to answer than for H1B visa.

I don't think people will get attracted by summarizing what we are doing...people should realize what we are doing...there is a difference...
The web site should be sufficient in providing information of a general nature.
More specific information and details should be available to members.
That's how many organizations operate, including AILA.
It's not just about the forums, this could come with a lot more benefits.

I don't think the only reason is "wife's cannot work".. The other reason for most is changing employers, and career growth while I-485 is in process.
You can keep changing employers once your I-140 is approved. You need to restart ur GC process but you can keep ur PD (if not revoked) and get a 3 year extension immediately based on the Approved I-140.
Sure it's not the best case scenario, but atleast you CAN do it. But for most married folk their spouses on H4 CANNOT work without EADs or waiting a year till the H1 quota opens. Even with the quota opening unless your spouse is into business or IT it is VERY tough to get an H1 for the spouse.

I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

EB3-I is the worst affected category and nobody even wants to talk about it.
I have been separated from my wife for 2 years and now I am going back and work in India.
I hope Media knows about this reverse brain drain that is reality and actually happening around here.
Thanks.

Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)
Yes I learnt this the hard way when I was fired from a fulltime job after working 4 years and contributing with a lot of hard work and dedication. I was fired in less than a minute and I was in 6th year of h1b. LOYALTY TO JOB MUST NOT BE FOR THE REASON THAT THEY HOLD YOUR VISA AND GREEN CARD. I moved out to consulting company and now work on %age and now I don't really care about being artificially loyal to any client. This is more healthy, resume gets built and you do not have to worry about losing your visa and status as long as you are in project, and as such changing projects is not difficult these days.
Most of the immigrants tend to be artificially inclined and have love and affection towards their companies just because Green card process is going on. Companies love to be cuddled by you but will not go out of their way for you.
The very reason logiclife and other folks started this group is because we are on our own. It is a fact that we are at no advantage with retrogression. Offcourse there are choices and one always has choices. Keeping quiet and accepting crap is not right. Whether we succeed or not, we must not accept crap as "fact of life". There is a saying "If you can walk, you can work".
I also agree that "working long hours + artificial loyalty" on h1b just for a GC is not proper reasoning for this cause. The actual reason behind this cause is a broken system that definitely needs too be fixed.

One of the approaches can be for state chapters to be involved and solicit donations from local members. I liked the idea for donations from immigrants who have already obtained green cards and online ADS from google as long as we do not overdo it. I am leaning more towards funding drives. For reasons that people in the process understand better than I do, I agree that the amounts cannot be disclosed. Hence it would be nice to have offline discussions or discussions on PMs on targets between state chapter members.
I for one am not for monthly payments or memberships. That just makes for exclusive organization and we want to be more inclusive.
I also had another important question we need to ask ourselves. Do we want to solicit funding or donations or participation? They are two very different things. Participation is not limited to monetary involvement but can include time and ability (designing banners, websites, writing letters et al.) donation.
Cheers

UN,
Have there been any updates on this case that you are at liberty to share?
Thanks in advance.
nothing yet.
Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

It would take at least 45 days. You will always get about a month's notice for the interview. As per my case, I got a notice on March 10, 2009 that my case was transferred to NBC and that I would have to attend an interview at local office. I got the interview notice around May 15th for the interview scheduled on June 25th.
Hard and Soft LUD recently stating case moved to local office. Does anybody has any idea on timeframe for interview call? Dates being current I want it asap.

I feel education should be rewarded (Every where). High skilled should get prefference.
chaanakya may be you should consider putting your words in soft intangiable worlds...
For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.
Seriously, how much more immature can we get?
Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.

There are more than just national anecdotes, however. Everyday Americans are affected. Since looking into the H-1B visa program, some of my constituents have come to me and spoken out against abuses they see.
Another constituent sent me a letter saying that he saw firsthand how foreign workers were brought in while Iowans with similar qualifications were let go. He tells me he is a computer professional with over 20 years experience. He was laid off and has yet to find a job. He states: I believe [my employer] has a history of hiring H-1B computer personnel at the expense of qualified American citizens.
I received a letter from a man in Arizona who works for a company that employs dozens of H-1B workers. When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.
I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?
From How Safe Is Your Job? (http://www.parade.com/articles/editions/2007/edition_07-01-2007/Intelligence_Report) By Lyric Wallwork Winik | parade, July 1, 2007
You could lose your job to a foreign workernot because hes cheaper but because he has better workplace skills and discipline. Thats the message Labor Secretary Elaine Chao hears from U.S. executives who are worried about Americas competitive future.
Beyond the cheaper cost of labor, U.S. employers say that many workers abroad simply have a better attitude toward work. American employees must be punctual, dress appropriately and have good personal hygiene, says Chao. They need anger-management and conflict-resolution skills, and they have to be able to accept direction. Too many young people bristle when a supervisor asks them to do something.
As for our job future, Chao notes that most of the fastest-growing jobs today are in industries requiring advanced knowledge and skills and are very high or high wage.

I know Aman has made a no. of trips to DC & these are not cheap.
Let us all contribute to pay back all his trips .
I am serious about it as people have no idea what people like Aman & others have done / sacrificed. If fact, we should authorize the Money Manager of IV to immediately release the entire amount Aman & others have spent since 19th December 2005.
I am sure IV must have funds to handle this... if not, atleast start a part payment each month immediately
I do not know, what is IV's internal procedure for these situations.

Agree with original post.
Numbers USA people are angry right wing citizens.
Calls from legal aliens who can't vote won't move lawmakers one bit. Money and votes are the only 2 things that matter to politicians.
Pressure groups and lobbyists have far more reach and influence. IV as a group can use lobbyists and other influence to get a lot more done. Individual phone calls are a waste.
DBCD
So you think its just coincidence that two of the lawmakers from Congressional Hispanic Caucus have decided to cosponsor the three lofgren bills at the same time that 200 of us have called? Despite the fact that the CHC has gone on record saying they will not support legal immigration reform unless it also has amnesty provisions, and the three bills are solely for legal immigration ?
